Hwy 67, Alvarado TX 76009 Kotickee@gmail.com 817-751-8931 PURCHASE AGREEMENT AKC #: AVID Euro microchip #: DOB: Dam: Color: Buyer: Email: The following terms constitute a sales agreement between the Owner/Seller/Breeder, Bill and Shally Trautwein, and the Buyer, __________, regarding the French Bulldog described above. These terms and conditions are entered into and agreed upon by all parties. TERMS OF SALE The parties agree that the total purchase price of this puppy is $2500.00. If a deposit is being made as a reservation for this puppy at the time of signing of this agreement, the balance including any shipping expenses will be paid prior to receiving the puppy. PURPOSE OF SALE This puppy is sold first and foremost as a member of the Buyers family and will live in the Buyers home, becoming a part of his family. The AKC registration application will be assigned to Buyer with limitations as a companion pet. The puppy will not be bred nor exhibited in confirmation dog shows. As a companion pet the puppy will be altered (spayed/neutered) by a qualified veterinarian at an appropriate age as determined by that veterinarian. The puppy will be maintained with daily care and nutrition, as well as veterinarian services necessary to meet the all needs including those specific to this unique breed of brachycephalic dwarfed canines. HEALTH WARRANTY Health data will be given to the Buyer at the time of transfer of the puppy. All health costs including vaccinations and veterinary services will be the responsibility of the Seller until the time of delivery. Thereafter, the Buyer will assume responsibility for any costs incurred. The Seller will continue to warrant the sound health and development of this dog until it is eighteen months of age, regarding the following genetic health conditions: Bone loss or deformity of the skeletal structure that might result in crippling conditions. Congenital heart, lung or respiratory problems not characteristic of the breed. Blood disorders that involve an inability of adequate clot below average expectations for the breed. Tumors or malignancy. Neurological or endocrine problems and/or physical deformities that would significantly hinder the quality of life of the dog. The Buyer is aware that this breed was developed as a brachycephalic dwarfed canine and therefore the skeletal structure and respiratory system may not be typical compared with other canines. This warranty is intended to consider serious genetic defects that may significantly impair the quality of life of the dog and prevent it from fulfilling its intent of companion pet. It is not intended to cover mere cosmetic faults or weaknesses listed in the AKC Breed Standard. This warranty does not include accidental death or dismemberment of this dog if such incident occurs while the dog is in the possession of the Buyer or his agent. If some unforeseen health issue evolves during the first eighteen months of age of this dog, as described in the above items of warranty, the dog will be returned to the Seller with its AKC registration reassigning ownership to the Seller. The Seller will thereupon replace this dog with a sound specimen that may fulfill the expectations and purposes for which this puppy was purchased. Evidence of warranted problem and subsequence replacement procedure is: Immediately notify Seller in writing of such problem and desire to return dog for replacement. Provide a veterinarian report, lab data and/or x-ray information to the Sellers veterinarian. Provide proof that the dog’s health was maintained by appropriate vaccinations, exams and any needed medication. Return the dog to the Seller assuming any expense, as soon as it is feasible to arrange transport. If the condition of the dog is such that the dog can not be safely returned to the Seller, then the parties with the aid and advice of veterinarians will discuss and agree upon appropriate measures, keeping the best interests of the dog in mind. Parties agree to amicably cooperate in the selection of any replacement puppy. The Seller does however; retain the right to make the final decision regarding an appropriate replacement. It is understood that if this dog is euthanized without the written permission of the Seller, the health warranty is null and void. All warranties are for REPLACEMENT only and not for REFUND of purchase price in whole or part, not for REIMBURSEMENT of medical/veterinary expenses in whole or part. RELOCATION/SELLING OF DOG BY BUYER The Buyer agrees that this French Bulldog will never be sold to a "backyard breeder", commercial breeder, pet store owner, animal broker (or brokerage) nor placed with an animal auction facility for re-homing/resale. This dog will not be released to any Rescue Organization or Shelter. The Buyer will make every attempt to find a secure, safe and permanent home in the re-homing process. The Sellers advice and aid may be requested in this process. TRANSFER OF AKC REGISTRATION By signing this agreement, the Buyer acknowledges receipt of appropriate AKC registration and microchip information. This document will then constitute the entire agreement between Buyer and Seller. This agreement will be governed by, and construed in accordance with the laws of the State of Texas. Any and all legal disputes resulting from this agreement shall be remedied in the County of Johnson, State of Texas. All parties have read and understand the terms in this agreement.
